By accessing, registering on, or using any part of the IT PRIME JOBS platform — including the website at www.itprimejobs.com, the mobile application, resume database, job alert service, employer portal, or any associated digital service — you confirm that you have read, fully understood, and unconditionally agree to be legally bound by these Terms and Conditions in their entirety. These Terms constitute a legally binding contract between you and IT PRIME JOBS. If you do not agree to any provision of these Terms, you must immediately discontinue use of the platform and contact us to delete your account.

1. DEFINITIONS & INTERPRETATION

TERM MEANING
‘IT PRIME JOBS’, ‘we’, ‘us’, ‘our’ The platform IT PRIME JOBS, operated as part of the IT PRIME ecosystem (which includes IT PRIME NEWS and IT PRIME TV), accessible at www.itprimejobs.com.
‘Platform’ The website at www.itprimejobs.com, any associated mobile applications, APIs, email services, portals, and all digital infrastructure and features operated by IT PRIME JOBS.
‘User’, ‘you’, ‘your’ Any individual or organisation that accesses, registers on, or uses the Platform in any capacity.
‘Job Seeker’ Any individual who creates a profile, uploads a resume, searches for jobs, or applies for positions through the Platform.
‘Employer’ / ‘Recruiter’ Any organisation, recruitment agency, hiring manager, or authorised representative that registers to post jobs or access the candidate database.
‘Candidate Profile’ The professional profile created by a Job Seeker, including resume, employment history, skills, education, and contact information.
‘Resume Database’ The searchable repository of Candidate Profiles maintained by IT PRIME JOBS and made accessible to verified Employers under agreed terms
‘Premium Services’ Paid features and services offered to Employers, including enhanced job postings, candidate database access, analytics, and talent sourcing tools.
‘Content’ All text, data, documents, images, files, information, and materials uploaded, submitted, or otherwise provided by Users on or through the Platform.
‘Verified Employer’ An Employer who has completed IT PRIME JOBS’ verification process, accepted the Data Access Agreement, and been granted access to the Resume Database.
‘Intellectual Property’ All patents, trademarks, service marks, trade names, logos, copyrights, database rights, design rights, trade secrets, and any other proprietary rights.
‘Terms’ These Terms and Conditions, together with the Privacy Policy, Cookie Policy, and any supplementary guidelines published by IT PRIME JOBS.
‘Agreement’ The binding contract formed between IT PRIME JOBS and the User upon registration or use of the Platform.
‘Force Majeure’ Any event beyond IT PRIME JOBS’ reasonable control, including but not limited to natural disasters, pandemics, cyberattacks, government orders, or telecommunications failures.
References to ‘including’ are illustrative and non-exhaustive unless explicitly stated otherwise. Headings are for navigation only and do not affect interpretation. The singular includes the plural and vice versa.

2. NATURE OF THE PLATFORM & SERVICES

2.1 What IT PRIME JOBS Is

IT PRIME JOBS is a digital recruitment platform that facilitates connections between Job Seekers and Employers within the technology, IT, and digital sectors. We provide the infrastructure, tools, and services necessary to enable this connection — including profile creation, job listing, resume database access, matching algorithms, job alerts, and communication tools.

2.2 What IT PRIME JOBS Is Not

Critical Limitation — Please Read Carefully

  • IT PRIME JOBS is an intermediary platform. We are NOT an employer, staffing agency, recruitment consultant, or employment agency.
  • We do NOT guarantee employment to any Job Seeker, regardless of profile completeness or platform activity.
  • We do NOT guarantee that Employers who access the Resume Database will contact, interview, or hire any particular candidate.
  • We do NOT verify, endorse, or take responsibility for the accuracy of job postings, employer profiles, or hiring decisions made by Employers.
  • We do NOT independently verify all credentials, work history, or qualifications stated by Job Seekers in their profiles.
  • We are NOT a party to any employment contract, offer of employment, or negotiation between a Job Seeker and an Employer.

2.3 Relationship Between Parties

IT PRIME JOBS acts solely as a platform intermediary. Any employment relationship established through the Platform is exclusively between the Job Seeker and the Employer. IT PRIME JOBS has no role in, and accepts no liability for, the outcome of any hiring process, job offer, employment terms, workplace conditions, or termination of employment arising from connections made through the Platform.

2.4 Service Availability

IT PRIME JOBS aims to provide continuous platform access but cannot guarantee uninterrupted availability. Services may be suspended temporarily for maintenance, security updates, or due to circumstances beyond our control. We will provide advance notice of planned downtime where reasonably practicable.

3. ELIGIBILITY & REGISTRATION

3.1 Eligibility Requirements

To register and use the IT PRIME JOBS Platform, you must meet all of the following eligibility criteria:
  • You must be at least 18 years of age. The Platform is not intended for individuals under the age of 18.
  • You must have the legal capacity to enter into a binding contract under applicable law.
  • You must not be barred from using the Platform under any applicable law or court order.
  • If registering as an Employer, your organisation must be a lawfully operating entity registered under applicable Indian law, or a foreign entity with a lawful business presence.
  • You must not have had a previous account permanently terminated by IT PRIME JOBS for a Terms violation, unless we have expressly granted reinstatement in writing.

3.2 Registration Process

Registration requires you to provide accurate, current, and complete information as prompted by the registration form. You agree to maintain and promptly update your registration information to keep it accurate, current, and complete throughout your use of the Platform. Providing false or misleading registration information is a material breach of these Terms and will result in immediate account termination.

3.3 Account Types

3.4 One Account Per Person / Entity

Job Seekers may maintain only one active personal account. Creating multiple accounts to circumvent a suspension, gain an unfair platform advantage, or misrepresent identity is a violation of these Terms. Employers may maintain one primary organisational account with multiple authorised sub-user logins, all governed by these Terms.

4. ACCOUNT RESPONSIBILITIES

4.1 Security of Credentials

You are solely responsible for maintaining the confidentiality of your username and password. You must not share your login credentials with any other person. IT PRIME JOBS will not be liable for any loss, damage, or harm resulting from unauthorised access to your account caused by your failure to protect your credentials. You agree to notify us immediately at security@itprimejobs.com upon becoming aware of any unauthorised use of your account.

4.2 Accuracy of Information

You are responsible for ensuring that all information in your account profile, resume, job postings, and any communications made through the Platform is accurate, truthful, complete, and not misleading. IT PRIME JOBS reserves the right to remove or suspend any account where there is reasonable evidence of false or misleading information.

4.3 Account Activity

You are responsible for all activity conducted through your account, whether or not authorised by you. If you believe your account has been compromised, you must change your password immediately and contact our security team. We may suspend an account where we reasonably believe it has been accessed without authorisation, pending investigation.

4.4 Profile Completeness

IT PRIME JOBS strongly encourages Job Seekers to maintain a complete and current profile. A complete profile significantly improves discoverability and matching outcomes. While profile completion is voluntary, we may restrict visibility of significantly incomplete profiles in employer search results in order to maintain the quality of the Resume Database.

4.5 Notification of Changes

You must promptly update your account information when your circumstances change — including contact details, employment status, location preferences, or availability for work. Outdated information on the Platform does not affect the binding nature of these Terms.

5. TERMS FOR JOB SEEKERS

5.1 Free Platform Access

IT PRIME JOBS provides its core services to Job Seekers at no charge. This includes profile creation, resume upload, job search and browsing, job applications, profile visibility to verified Employers, and receipt of job alert emails. We reserve the right to introduce optional premium features for Job Seekers in the future, which will be clearly labelled and offered on an entirely opt-in basis.

5.2 Resume Upload & Profile Data

By uploading your resume or creating a Candidate Profile on the Platform, you grant IT PRIME JOBS a non-exclusive, royalty-free, worldwide licence to store, display, process, and share your profile data with Verified Employers for the purpose of facilitating recruitment — subject to your privacy settings and our Privacy Policy. This licence continues for as long as your profile remains active on the Platform and expires upon deletion of your account

5.3 Candidate Visibility Settings

You have full control over the visibility of your profile through three settings, which can be changed at any time from your account dashboard:
  • Active / Visible: Your profile is fully searchable and contactable by Verified Employers — the default and recommended setting for active job seekers.
  • Confidential: Your profile is discoverable but your current employer name is masked, for discreet searching while employed.
  • Private / Inactive: Your profile is not searchable by Employers. You may still browse jobs and apply actively — your profile will only be shared when you explicitly apply.

5.4 Accuracy of Profile Representations

You represent and warrant that all information in your Candidate Profile is truthful and accurate. You must not misrepresent your qualifications, skills, experience, education, certifications, achievements, or any other professional information. Misrepresentation is a violation of these Terms and may constitute fraud, which IT PRIME JOBS reserves the right to report to appropriate authorities.

5.5 Responsibilities in the Application Process

When you submit a job application through IT PRIME JOBS, you authorise IT PRIME JOBS to transmit your application and Candidate Profile data to the relevant Employer. You remain solely responsible for the quality and accuracy of your application. IT PRIME JOBS is not responsible for any aspect of the recruitment process conducted by the Employer following submission of your application.

5.6 No Guarantee of Employment

IT PRIME JOBS makes no representation that using the Platform will result in employment, interviews, responses from Employers, or any particular career outcome. The Platform is a tool — results depend on market conditions, your individual profile, and Employer decisions entirely outside IT PRIME JOBS’ control.

5.7 Communications From Employers

If an Employer contacts you through the Platform, IT PRIME JOBS does not moderate, verify, or endorse those communications. You should exercise your own judgment before responding to any communication or agreeing to any request from an Employer, including requests for additional documents, references, or personal information outside the Platform.

6. TERMS FOR EMPLOYERS & RECRUITERS

6.1 Employer Verification

All Employers wishing to access the Resume Database or post job vacancies must complete IT PRIME JOBS’ verification process. This includes providing accurate organisation details, registering a legitimate business entity, signing our Data Access Agreement, and agreeing to our Employer Code of Conduct. IT PRIME JOBS reserves the right to refuse, suspend, or revoke Employer access at any time at its sole discretion.

6.2 Employer Representations & Warranties

By registering as an Employer on IT PRIME JOBS, you represent and warrant that:
  • Your organisation is a lawfully constituted entity in good standing under applicable law
  • All job postings you create represent genuine, current, and lawfully available vacancies
  • You have the legal authority and operational capacity to hire for the roles you post
  • You will use Candidate Profile data exclusively for recruitment and hiring purposes
  • You will handle all Candidate data in compliance with India’s DPDP Act 2023, the IT Act 2000, and all applicable data protection law
  • You will not discriminate against candidates on the basis of gender, religion, caste, disability, age, or any other characteristic protected under Indian law
  • You will not collect fees, deposits, or payments from Job Seekers as a condition of employment or job consideration

6.3 Employer Code of Conduct

Employers using the IT PRIME JOBS Platform must at all times:
  • Respond promptly to shortlisted candidates and communicate outcomes in a reasonable timeframe
  • Maintain the confidentiality of candidate information and not share it beyond the hiring team without candidate consent
  • Delete candidate data from their systems when no longer required for the specific recruitment purpose
  • Not use candidate contact details for any purpose outside the specific recruitment process for which the data was accessed
  • Not engage in misleading, abusive, or unprofessional communications with candidates
  • Report any data breach involving candidate data to IT PRIME JOBS within 24 hours of discovery

6.4 No Guarantee of Successful Recruitment

IT PRIME JOBS provides tools and access to facilitate recruitment but does not guarantee that Employers will find suitable candidates, fill vacancies, or achieve specific hiring outcomes through the Platform. Employers remain solely responsible for their own recruitment decisions, employment contracts, and compliance with employment law.

7. RESUME DATABASE — ACCESS & CONDUCT RULES

7.1 Access Conditions

Access to the IT PRIME JOBS Resume Database is a privilege granted to Verified Employers who have entered into a Data Access Agreement. Access is subject to continued compliance with these Terms, the Data Access Agreement, and our Privacy Policy. Access may be revoked immediately and without notice if these conditions are violated.

7.2 Permitted Use of Resume Database

  • Searching for and reviewing candidate profiles relevant to specific, current, genuine vacancies
  • Contacting candidates through the Platform’s messaging system to discuss relevant opportunities
  • Downloading or exporting profiles strictly for internal recruitment process management, in accordance with the Data Access Agreement
  • Storing candidate data in internal ATS (Applicant Tracking Systems) for the duration of the relevant recruitment process

7.3 Prohibited Use of Resume Database

The following uses of Resume Database access are strictly prohibited and constitute grounds for immediate termination:

  • Selling, licensing, sub-licensing, or otherwise transferring candidate data to any third party
  • Using candidate data for purposes other than recruitment — including market research, list building, or profiling for commercial analysis
  • Contacting candidates for purposes unrelated to the specific vacancy for which their profile was accessed
  • Using candidate contact details to add individuals to marketing or communication lists without their separate and explicit consent
  • Scraping, bulk downloading, or otherwise extracting the Resume Database through automated means
  • Sharing database access credentials with individuals outside your verified organisation
  • Using the database to recruit candidates for competitors of IT PRIME JOBS
  • Accessing candidate profiles on behalf of a client without disclosing to the candidate that you are acting as a recruitment agency intermediary

7.4 Audit Rights

IT PRIME JOBS reserves the right to audit Employer use of the Resume Database at any time. Employers must maintain and provide access to records of their candidate data handling on request. Failure to comply with an audit request will result in immediate suspension of database access.

8. PROHIBITED CONDUCT

The following conduct is prohibited for all Users of the IT PRIME JOBS Platform, regardless of account type. Violation of any prohibition listed below will result in immediate account suspension or permanent termination, and may result in legal action:

8.1 Identity & Misrepresentation

  • Impersonating any person, company, or organisation, or misrepresenting your identity or affiliation
  • Creating a profile, job posting, or application under a false name or on behalf of an entity that does not exist
  • Using another person’s credentials, profile, or identity to access or use the Platform
  • Falsifying or exaggerating professional qualifications, skills, experience, or achievements

8.2 Fraudulent, Harmful & Illegal Activity

  • Posting fraudulent job listings — vacancies that do not exist, involve illegal activities, or are designed to collect personal data from candidates under false pretences
  • Charging candidates fees or deposits as a condition of employment consideration or job offer
  • Using the Platform to facilitate money laundering, financial fraud, identity theft, or any criminal activity
  • Threatening, harassing, abusing, or discriminating against any User of the Platform
  • Posting content that is defamatory, obscene, sexually explicit, hateful, or incites violence

8.3 Technical Interference

  • Attempting to access, alter, or interfere with any part of the Platform for which you are not authorised
  • Using automated scripts, bots, scrapers, or crawlers to extract data, create accounts, or interact with the Platform at scale
  • Introducing malware, viruses, trojans, or any other harmful code into the Platform
  • Circumventing, disabling, or otherwise interfering with security features or access controls
  • Attempting to reverse engineer, decompile, or disassemble any software component of the Platform

8.4 Platform Integrity

  • Posting duplicate, misleading, or irrelevant job listings to artificially inflate visibility
  • Manipulating job alert systems, search rankings, or recommendation algorithms through artificial means
  • Using the Platform to advertise services unrelated to legitimate recruitment and employment
  • Soliciting or receiving kickbacks, referral fees, or undisclosed payments in connection with recruitment activity conducted through the Platform

9. INTELLECTUAL PROPERTY RIGHTS

9.1 IT PRIME JOBS' Intellectual Property

All Intellectual Property in and relating to the IT PRIME JOBS Platform — including but not limited to the brand name, logo, trade marks, trade dress, website design, user interface, software code, matching algorithms, database architecture, and proprietary content — is owned by or licensed to IT PRIME JOBS and is protected under Indian and international intellectual property law. Nothing in these Terms grants you any right, licence, or interest in IT PRIME JOBS’ Intellectual Property except the limited, non-exclusive right to use the Platform for its intended purpose as set out in these Terms.

9.2 User Content Licence

By submitting Content to the Platform — including your Candidate Profile, resume, job postings, or communications — you grant IT PRIME JOBS a non-exclusive, royalty-free, sublicensable, worldwide licence to use, store, process, reproduce, and distribute that Content for the purposes of operating the Platform and delivering the services described in these Terms. This licence does not grant IT PRIME JOBS ownership of your Content. You retain full ownership of all Content you submit.

9.3 Restrictions on Platform Content

You may not copy, reproduce, republish, download, transmit, distribute, or create derivative works from any content on the Platform without IT PRIME JOBS’ prior written consent, except as expressly permitted by these Terms or applicable law. Systematic extraction of Platform content — including job listings, employer profiles, or candidate data — for any purpose outside your personal account use is strictly prohibited.

9.4 Third-Party Intellectual Property

IT PRIME JOBS respects the intellectual property rights of third parties and requires all Users to do the same. Do not upload, submit, or share Content on the Platform that infringes any third party’s copyright, trademark, patent, trade secret, or other proprietary right. IT PRIME JOBS will remove infringing content and may terminate accounts of repeat infringers

9.5 Feedback & Suggestions

Any feedback, suggestions, ideas, or improvements you provide to IT PRIME JOBS regarding the Platform (‘Feedback’) are given voluntarily and without any expectation of compensation. By providing Feedback, you grant IT PRIME JOBS an irrevocable, perpetual, worldwide, royalty-free licence to use, implement, and build upon that Feedback in any manner without restriction or obligation to you.

10. CONTENT STANDARDS & ACCURACY

10.1 User Responsibility for Content

You are solely responsible for all Content you submit, post, or communicate through the Platform. IT PRIME JOBS does not pre-screen all Content and cannot guarantee the accuracy, completeness, legality, or appropriateness of Content posted by Users. The views and information expressed in User Content are those of the individual User and do not represent the views, endorsement, or recommendation of IT PRIME JOBS.

10.2 Content Standards

All Content you submit must comply with the following standards:
  • Truthful and accurate — no false statements of fact, misrepresentation, or fabrication
  • Lawful — Content must not violate any applicable law or regulation
  • Respectful — Content must not be discriminatory, abusive, threatening, or offensive
  • Relevant — Content must be relevant to the recruitment and employment purpose of the Platform
  • Non-infringing — Content must not infringe any third party’s intellectual property rights
  • Appropriate — Content must not be sexually explicit, violent, or contain hate speech

10.3 Content Moderation & Removal

IT PRIME JOBS reserves the right, but does not assume the obligation, to review, moderate, edit, remove, or refuse to publish any Content that in our reasonable judgement violates these Terms, applicable law, or the standards of a professional recruitment platform. We may act on Content without prior notice. Users may report inappropriate Content by writing to legal@itprimejobs.com.

10.4 Accuracy of Job Listings

Employers are responsible for ensuring that all job postings are accurate, complete, current, and representative of genuine vacancies. IT PRIME JOBS does not independently verify the accuracy of job postings. If a job posting contains inaccurate information that causes harm to a candidate — including misleading salary ranges, false role descriptions, or non-existent vacancies — the posting Employer bears full responsibility.

11. JOB POSTINGS — EMPLOYER OBLIGATIONS

11.1 Accuracy & Completeness

Every job posting on IT PRIME JOBS must represent a genuine, currently available vacancy. Job postings must include an accurate job title, a clear and honest description of duties and responsibilities, the location or remote work arrangement, a realistic salary range or ‘competitive’ if genuinely applicable, and the required qualifications and experience. Deliberately misleading job postings are a material breach of these Terms.

11.2 Legal Compliance

Every job posting on IT PRIME JOBS must represent a genuine, currently available vacancy. Job postings must include an accurate job title, a clear and honest description of duties and responsibilities, the location or remote work arrangement, a realistic salary range or ‘competitive’ if genuinely applicable, and the required qualifications and experience. Deliberately misleading job postings are a material breach of these Terms.

11.3 Prohibited Job Posting Content

  • Postings for roles that do not exist or are not currently being actively recruited for
  • Postings that require candidates to pay any fees, purchase products, or make any financial commitment as a condition of consideration or employment
  • Postings that involve illegal activities, pyramid schemes, or multi-level marketing schemes
  • Postings that are excessively vague for the purpose of harvesting candidate data without genuine intent to hire
  • Duplicate postings for the same role beyond what is necessary for legitimate visibility

11.4 Job Posting Duration & Renewal

Standard job postings are active for the period defined in your selected plan. Employers are responsible for removing or marking as closed any job posting for a vacancy that has been filled or withdrawn. IT PRIME JOBS may remove job postings that appear inactive or unfilled after extended periods at our discretion.

12. APPLICATION PROCESS & CANDIDATE CONDUCT

12.1 Submitting Applications

When you apply for a job through IT PRIME JOBS, you authorise us to transmit your Candidate Profile and application materials to the Employer for the purpose of the specific application. Each application constitutes a separate and independent communication between you and the Employer. IT PRIME JOBS does not participate in, mediate, or take responsibility for the conduct of the recruitment process following submission.

12.2 Application Conduct

Job Seekers must apply only for positions for which they genuinely intend to be considered. You must not use the application system to contact Employers for purposes unrelated to the posted vacancy, send unsolicited marketing materials, or engage in any form of harassment or abuse of Employers through the application mechanism.

12.3 Communication Standards

All communications between Job Seekers and Employers conducted through the Platform must be professional, honest, and relevant to the recruitment purpose. IT PRIME JOBS reserves the right to monitor communications for compliance with these Terms and to remove or block communications that violate our standards or applicable law.

12.4 Interview & Offer Process

IT PRIME JOBS is not responsible for any aspect of the interview, assessment, or offer process conducted by Employers. If you believe you have experienced unlawful discrimination, harassment, or unprofessional conduct during a recruitment process facilitated through our Platform, you may report this to legal@itprimejobs.com. We will investigate credible reports and may take action against the relevant Employer account.

13. PAYMENT TERMS (PREMIUM SERVICES)

13.1 Premium Services for Employers

IT PRIME JOBS offers a range of paid Premium Services to Employers, including enhanced job posting visibility, priority placement, Resume Database access tiers, candidate search filters, talent analytics, and talent sourcing support. Current pricing for all Premium Services is published on our website and may be updated from time to time. All prices are in Indian Rupees (INR) and are inclusive of applicable GST unless otherwise stated.

13.2 Payment Processing

All payments for Premium Services are processed through our authorised third-party payment gateway partners. IT PRIME JOBS does not store your payment card details on our servers. By making a payment, you authorise the relevant payment gateway to process the transaction in accordance with their terms. IT PRIME JOBS will issue a tax invoice (with GST breakdown) for all paid transactions within 24 hours of successful payment.

13.3 Payment Obligations

  • All fees are due and payable in advance of service activation unless a credit arrangement has been expressly agreed in writing by IT PRIME JOBS
  • You are responsible for all taxes applicable to your use of Premium Services under Indian law
  • IT PRIME JOBS reserves the right to suspend or downgrade Premium Services where payment is outstanding beyond the due date
  • Disputed transactions must be notified to accounts@itprimejobs.com within 14 days of the payment date. After 14 days, transactions are deemed accepted.

13.4 Price Changes

IT PRIME JOBS reserves the right to amend the pricing of Premium Services. We will provide at least 30 days advance notice of any price change by email to your registered account address. Continued use of Premium Services after the effective date of a price change constitutes acceptance of the new pricing.

14. SUBSCRIPTION PLANS & RENEWALS

14.1 Subscription Terms

Employer Premium Services are available on monthly or annual subscription terms. Subscription terms, pricing, and features are detailed on the Platform’s pricing page. Annual subscriptions are offered at a discounted rate compared to monthly billing.

14.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. IT PRIME JOBS will send a renewal reminder by email at least 7 days before your subscription renewal date. The renewal will be charged to your registered payment method. You can cancel auto-renewal at any time from your account billing settings.

14.3 Upgrading & Downgrading

You may upgrade your subscription plan at any time. The additional cost for the upgrade will be calculated on a pro-rated basis for the remainder of the current billing period. Downgrading to a lower plan will take effect at the start of the next billing period. No refund or credit is given for the difference in subscription value if you downgrade mid-period.

14.4 Enterprise Agreements

For high-volume recruitment needs, IT PRIME JOBS offers custom enterprise pricing and service agreements. Enterprise clients should contact enterprise@itprimejobs.com to discuss bespoke arrangements. Enterprise agreements are subject to separate contractual terms in addition to these Terms and Conditions.

15. REFUND & CANCELLATION POLICY

15.1 General Refund Policy

IT PRIME JOBS operates a clear and fair refund policy. All refund claims must be submitted to accounts@itprimejobs.com within the timeframes specified below. Refunds are processed to the original payment method within 7 to 14 working days of approval.

Refunds will not be granted where the service was used prior to the cancellation request, where the claim is made outside the timeframes specified above, or where the reason for dissatisfaction relates to recruitment outcomes (e.g. no suitable candidates found) rather than a service delivery failure.

15.2 Non-Refundable Items

  • Completed candidate shortlisting reports and talent mapping deliverables
  • Platform credits that have been fully or partially consumed
  • Resume database access fees where the database was accessed
  • Payment gateway processing fees

16. DISCLAIMERS & LIMITATION OF LIABILITY

THE IT PRIME JOBS PLATFORM IS PROVIDED ON AN ‘AS IS’ AND ‘AS AVAILABLE’ BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IT PRIME JOBS EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

16.2 No Guarantee of Results

IT PRIME JOBS does not warrant that:
  • Use of the Platform will result in employment, interviews, job offers, or any specific hiring outcome for Job Seekers
  • Use of the Platform will result in finding suitable candidates, filling vacancies, or achieving hiring targets for Employers
  • The Platform will be free from errors, interruptions, or security vulnerabilities at all times
  • Any information provided by other Users (including qualifications claimed by candidates or descriptions given by Employers) is accurate, complete, or reliable

16.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW:

  • IT PRIME JOBS’ total aggregate liability to any User — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — shall not exceed the total fees paid by that User to IT PRIME JOBS in the 3 months immediately preceding the event giving rise to the claim.
  • For free services (including Job Seeker accounts), IT PRIME JOBS’ total liability is capped at INR 5,000.
  • IT PRIME JOBS shall not be liable for any indirect, special, consequential, incidental, or punitive loss or damage, including loss of business, loss of profit, loss of revenue, loss of data, or loss of opportunity — regardless of whether such loss was foreseeable.
  • IT PRIME JOBS is not liable for any loss arising from your reliance on information in job postings, employer profiles, or other User Content on the Platform.
  • IT PRIME JOBS is not liable for the conduct, acts, or omissions of any Employer or Job Seeker in connection with any recruitment process.

16.4 Exceptions

Nothing in these Terms excludes or limits IT PRIME JOBS’ liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Indian law.

17. INDEMNIFICATION

You agree to fully indemnify, defend, and hold harmless IT PRIME JOBS, its officers, directors, employees, agents, and ecosystem partners (IT PRIME NEWS and IT PRIME TV) from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
  • Your use of the Platform in violation of these Terms or applicable law
  • Any Content you submit, post, or transmit through the Platform
  • Your misrepresentation of identity, qualifications, or organisational status
  • Your violation of any third party’s intellectual property rights, privacy rights, or other legal rights through your use of the Platform
  • Any claim by a candidate arising from your conduct as an Employer, including unlawful discrimination, data misuse, or unprofessional conduct
  • Any claim by an Employer arising from a Job Seeker’s fraudulent profile, misrepresented credentials, or conduct in the application process
  • Your breach of any representation or warranty made in these Terms
This indemnification obligation survives termination of your account and these Terms. IT PRIME JOBS reserves the right to assume exclusive control of its defence in any matter to which you owe an indemnification obligation. You will not settle any claim that imposes obligations on IT PRIME JOBS without our prior written consent.

18. THIRD-PARTY LINKS & SERVICES

The IT PRIME JOBS Platform may contain links to third-party websites, applications, and services — including employer career pages, professional networks, job aggregators, and payment gateways. These links are provided for convenience only. IT PRIME JOBS does not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party service.
Your use of third-party services is entirely at your own risk and is governed by the terms and privacy policies of those services, not by these Terms. We recommend that you review the terms and privacy policies of any third-party service before using it. IT PRIME JOBS is not responsible for any loss or harm arising from your interaction with third-party services accessed through or in connection with our Platform.

19. PLATFORM AVAILABILITY & MODIFICATIONS

19.1 Service Availability

IT PRIME JOBS endeavours to maintain high platform availability. However, we do not guarantee uninterrupted, error-free, or secure access to the Platform at all times. Planned maintenance, security updates, infrastructure upgrades, or events beyond our control may cause temporary interruptions. We will provide advance notice of planned maintenance where reasonably practicable.

19.2 Right to Modify the Platform

IT PRIME JOBS reserves the right to modify, enhance, reduce, suspend, or discontinue any feature, service, or aspect of the Platform at any time. We may introduce new features, change existing features, or remove features that are no longer viable or necessary. Where a material modification removes a feature you have paid for, we will provide a pro-rated refund or service credit at our election.

19.3 Force Majeure

IT PRIME JOBS will not be liable for any failure or delay in performance caused by a Force Majeure event, including natural disasters, epidemics, pandemics, government restrictions, cyberattacks, power failures, telecommunications disruptions, or other events beyond our reasonable control. We will use commercially reasonable efforts to restore service as promptly as possible following a Force Majeure event.

20. ACCOUNT SUSPENSION & TERMINATION

20.1 Termination by You

You may close your IT PRIME JOBS account at any time through your account settings or by writing to support@itprimejobs.com. Upon closure, your profile will be removed from employer search results within 24 hours. Your data will be retained for the period specified in our Privacy Policy, after which it will be permanently deleted. Any unused paid plan credits remaining at the time of cancellation are non-refundable unless a refund is expressly available under Section 15.

20.2 Termination by IT PRIME JOBS

IT PRIME JOBS reserves the right to suspend or permanently terminate your account at any time, with or without notice, if:
  • You violate any provision of these Terms or our Employer Code of Conduct
  • We receive credible reports of fraudulent, abusive, or illegal conduct connected to your account
  • Your account is found to contain materially false or misleading information
  • You use the Platform in a way that causes harm to other Users, third parties, or the Platform’s integrity
  • Your account remains inactive for more than 36 consecutive months and you have not responded to re-engagement notices
  • We are required to do so by applicable law or a regulatory or court order

20.3 Effects of Termination

Upon termination, your right to access and use the Platform immediately ceases. IT PRIME JOBS will retain your data in accordance with our Privacy Policy and applicable law. Clauses in these Terms that by their nature should survive termination — including indemnification, intellectual property, limitation of liability, and governing law — shall survive.

20.4 Appeals

If your account is suspended or terminated by IT PRIME JOBS and you believe the action was taken in error, you may submit a written appeal to legal@itprimejobs.com within 14 days of the suspension or termination notice. We will review all appeals in good faith and respond within 14 working days.

21. DISPUTE RESOLUTION & GRIEVANCE MECHANISM

21.1 Good Faith Resolution

IT PRIME JOBS is committed to resolving disputes fairly, promptly, and in good faith. If you have a dispute, complaint, or grievance regarding the Platform, its services, or the conduct of another User, we encourage you to contact us before pursuing formal legal action. Most issues can be resolved efficiently through our support and grievance channels.

21.3 Escalation Process

If your complaint is not resolved to your satisfaction within 30 days, you may escalate to the Data Protection Board of India for privacy-related matters, or pursue the matter through the dispute resolution mechanisms set out in Section 22.

21.4 User vs. User Disputes

Disputes between Job Seekers and Employers — including matters relating to interview conduct, job offer accuracy, data misuse, or unprofessional behaviour — are primarily between those parties. IT PRIME JOBS may, at its discretion, facilitate a resolution by reviewing relevant Platform communications and taking appropriate account action. IT PRIME JOBS is not a mediator or arbitrator and is not legally obligated to resolve user-to-user disputes.

22. GOVERNING LAW & JURISDICTION

These Terms and Conditions, and all disputes arising out of or in connection with them or the use of the IT PRIME JOBS Platform, are governed by and construed in accordance with the laws of the Republic of India, including but not limited to:
  • The Information Technology Act, 2000 (as amended)
  • The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
  • The Digital Personal Data Protection Act, 2023
  • The Indian Contract Act, 1872
  • The Consumer Protection Act, 2019 (where applicable)
  • The Specific Relief Act, 1963
Any legal proceedings arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India. Both parties agree to submit to the personal jurisdiction of such courts and waive any objection to jurisdiction or venue in those courts.
For Employer Users who are entities incorporated outside India, any cross-border dispute resolution will be subject to mutual agreement on applicable legal framework, with Indian law as the default governing law in the absence of such agreement.

23. AMENDMENTS TO THESE TERMS

23.1 Right to Amend

IT PRIME JOBS reserves the right to amend, update, or replace these Terms at any time. We will not make material changes to these Terms without providing appropriate notice.

23.2 Notification of Material Changes

  • Material changes — those that affect User rights, obligations, liability, or the core services available — will be communicated by email to your registered address at least 30 days before the new Terms take effect
  • Non-material changes — such as clarifications, formatting corrections, or minor additions that do not affect your rights — will be updated with a revised effective date and a summary note
  • All prior versions of these Terms are archived and available for reference on our website

23.3 Acceptance of Amended Terms

Your continued use of the Platform after the effective date of any amended Terms constitutes your binding acceptance of the updated Terms. If you do not accept an amended version of these Terms, you must discontinue use of the Platform and may request deletion of your account before the amended Terms take effect.

24. MISCELLANEOUS PROVISIONS

24.1 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and any supplementary guidelines or special terms published by IT PRIME JOBS, constitute the entire agreement between you and IT PRIME JOBS with respect to your use of the Platform and supersede all prior agreements, representations, negotiations, and understandings between the parties relating to the same subject matter.

24.2 Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be severed from the remainder of these Terms, which shall continue in full force and effect. The severed provision shall be replaced with a valid provision that most closely approximates the intent of the original.

24.3 No Waiver

IT PRIME JOBS’ failure to enforce any provision of these Terms on any occasion does not constitute a waiver of that provision or of IT PRIME JOBS’ right to enforce it on any future occasion. No waiver of any right under these Terms is effective unless given in writing by IT PRIME JOBS.

24.4 Relationship of the Parties

Nothing in these Terms creates, or is intended to create, a partnership, joint venture, agency, employment relationship, or franchise between IT PRIME JOBS and any User. You acknowledge that you are an independent party using a third-party platform, not an agent or representative of IT PRIME JOBS.

24.5 Assignment

You may not assign, transfer, or sub-licence your rights or obligations under these Terms without IT PRIME JOBS’ prior written consent. IT PRIME JOBS may assign these Terms, including all rights and obligations, to any successor entity or purchaser of our business or assets without your consent, provided that your rights under these Terms are not materially diminished as a result.

24.6 Notices

All formal notices under these Terms must be in writing. Notices to IT PRIME JOBS must be sent by email to legal@itprimejobs.com. Notices to you will be sent to your registered email address. Notices are deemed received: by email, on the next working day after sending (provided no delivery failure notice is received); and by post, 5 working days after posting by recorded delivery.

24.7 Language

These Terms are drafted in the English language. In the event of a conflict between an English version and any translation provided for convenience, the English version shall prevail.

  • Job Matching Algorithms: We use automated systems to match candidate profiles to job listings based on skills, experience, location, and preferences. These systems generate recommendations but do not make final hiring decisions — all hiring decisions are made by human employers.
  • Search Ranking: Candidate profiles may be ranked in employer search results based on relevance signals including profile completeness, skill match, recent activity, and application responsiveness.
  • Fraud Detection: Automated systems monitor for suspicious activity, fake profiles, and platform misuse. These systems may flag accounts for human review.

  • You have read these Terms and Conditions in full
  • You understand the rights and obligations these Terms create
  • You agree to be legally bound by these Terms
  • You meet the eligibility requirements set out in Section 3
  • If acting on behalf of an organisation, you have the authority to bind that organisation to these Terms
These Terms are effective from March 30, 2026, and supersede all prior terms of service published by IT PRIME JOBS.
